Website Terms and Conditions of COMERCIO EUROPEO CESA, S.A.

 

I. DESCRIPTION OF SERVICE PROVIDED

We are providers of Internet services and offer to users and members a site that allows owners to publish advertises of tourist accommodation or short stay and also prospective tenants are advised to contact the owners by providing the reservation. We are not an estate agent and do not act as intermediaries or as agents, but as a hostel our service is based on the information we get from accommodation and the owners.

We offer several options on this website for the owners, details are shown in sections named [VIEW DESCRIPTIONS]::

1) Acceptance  

COMERCIO EUROPEO CESA, S.A. offers an online platform where you can book on-line tourist properties or short stay. These services are subject to our conditions of use. If you use our services, means that you agree to be bound to comply with these conditions. Users agree to be bound by all the rules and instructions, that at any time may be modified in the best manner we deem appropriate. For all that the user knows it is his responsibility to check the conditions frequently.

 

2) Credit Card and Credit Guarantee:
To make an online reservation booking Holder must necessarily be the same as the cardholder who paid for it.
In cases that this condition can not be effective ( paying for a child or for a member of the family, etc.) Must contact us by phone (speaking Spanish) to the number 659856226 or mail to reserv@apartamentosencostarica.cr , giving the reasons and we´ll make a personal booking.

 El customer / tenant, when making a reservation, accepts an agreement directly with the accommodation you have chosen and will be charged to your credit card an amount of 15% of the total as a payment for reservation services. Then we will confirm the reservation by providing all necessary data and exact address of contact for your arrival. The rest of the amount or the bail(if any) will be paid to the owner by the way he has set when you arrive the shelter, or any other payment arrangement they have agreed.

 

3) Payment by bank transfer: 
To make a reservation by bank transfer you must select this mode at the end of the booking process of a property. At that instant the system will present the amounts and concepts employed, and show the bank details so you can pay and the system will lock the days that you selected when booking. You have 2 days to submit proof of your order

The client / tenant to make a reservation directly accept an agreement with the accommodation you have selected. In the instant the transfer fee be effective, it will confirm the reservation by providing all necessary data and exact address of contact for your arrival via email that you identify as a form of contact. The remaining amount and deposit (if applicable) is paid directly to the owner and the method he has set to reach the shelter, or any other payment agreement they have agreed.

4) Cancellation

To cancel a reservation you must send a notice by mail
prior to the limit stipulated by the establishment's cancellation policy detailed in the confirmation.
Please read the cancellation policy of your e-mail reservation confirmation for further information.

The amount of the reservation will not be returned to the client in any case, although this may cancel the reservation and apply the amount paid for other stocks, with the following restrictions:

- Cancellations notified 30 days or more in advance will be refunded with 90% of the amount paid. 

- Cancellations notified within 15 to 30 days will be refunded with 50% of the amount paid.  

- Cancellations notified less than 15 days in advance will lose the total amount paid for the booking 

In any case the amount retained will be less than 20 Euros for expenses. The customer will support the costs of returning bank.

 

The customer bears the costs of reimbursing bank.  

 

5) Disclaimer:

Our website has been built in good faith, but you should verify the information before you act upon it. Under no circumstances will we be liable for any loss of profit, directly or indirectly as a result of using our services. Our responsibility is always limited to the amount paid online to Pontega SL as a booking of your stay.

 

Comercio Europeo Cesa, S.A. doesn´t take responsibility for the accuracy of the photos and the information provided by third parties in apartments and other accommodations that appear on the website. This website publishes the category of accommodation as a guide and can not guarantee its accuracy.

 

As host, we are not responsible for:

- The truth or accuracy of the timing of availability for the apartments in the published form of "Partial Management" and "Management Free" (outlined in section I), being the responsible for updating only the owner. For this reason, it is always advisable that after making the reservation, the tenant should contact the owner to confirm the published data. In case of inconvenience in this regard, the user will always have the right to cancel his reservation according to the terms outlined in section II, paragraph 3 herein. 

- As for the accuracy of the content transmitted or stored on your site, if we find any images or content that we deem offensive, illegal, fraudulent or not complying with the terms and conditions, it shall be removed immediately without any claim by the owner responsible for such content . Pontega doesn’t take responsibility for any error or service interruption due to causes or motives of other parties. Any registered user to use the services we offer, is supposed to accept totally the terms of use.

 

6) BLOCKADE OF USERS:

CESA will block access to the site to any recurrent infringer user . A recurrent infringer is a user that has been reported to be violating one or more of the Terms and Conditions.

 

7) USER AGREES:

- Where the breach of the conditions described in this document will assume any costs resulting from damages, court costs or any other resulting from maintaining that we are not paid under the agreed terms should be responsible for those costs.

- Do not advertise or post any form of content:

o contrary to the law of Spain.

o That is not entitled or in the Content for which you will make available to the public.

o is harmful, unlawful, threatening, abusive, harassing, defamatory, pornographic, libelous, invades the privacy of others or to harm minors in any way;

o or harass an individual or group who goes against the Spanish Constitution.

o Or include information not appropriate without the consent of that.

o is misleading or constitutes fraud.

o Or constitutes or contains "affiliate marketing", a reference code to link "," junk mail, "" spam, "" chain letters, "" pyramid schemes "or unsolicited commercial advertisement

o or constitutes any form of advertising or promotion without being authorized by Pontega SL

o Sell or publish different from our purpose.

o or contains software viruses or other code, files or software.

o or use misleading email addresses, or forged headers.

o or collect personal data about other users for commercial or contrary to law.

o or post the same apartment several times.

 

8) NOTICE OF CLAIMS TO VIOLATIONS.

9) REQUIREMENTS TO ACCEPT THESE TERMS

You must be 18 years or older, or be an emancipated minor or to have legal parental and / or guardian permission and be fully qualified and competent to enter into these Terms and Conditions. In any case, you must be older than 13 years, since CESA site was not designed for younger than 13 years.

 

10) TRADEMARK, COPYRIGHT, LINKS, APPLICABLE LAW:

All material on this website (as well as their willingness and DTP) belongs to Comercio Europeo Cesa, S.A., established in San José (Costa Rica) . Their rights and their logos are registered trademarks or trademarks of "CESA”. 
In no case you may modify, copy, distribute, transmit, display, reproduce, publish, license, create derivative works of, use on another website, transfer or sell any information, software, lists of users, databases or other lists products or services obtained through this website. Unless written permission of CESA you agree not to reproduce, transmit or distribute materials protected by copyright, access or attempt to gain access to this site password protected, secure or non-public.


This site may contain hyperlinks to other websites or information of third parties who rely on entities different from ours and are provided only as a reference and background, so we have no control over them and we don´t take responsibility for their contents or for the use of them. We are registered in Costa Rica and the Costarican law are applicable to our services, the Courts and Tribunals to settle any dispute will the ones in San José (Costa Rica)


11) SPECIAL CONDITIONS.

Estas opciones son:

I- Personalized Management:

A) Promootion and publication of your property with texts written by the owner, up to 20 photos and features.
B) published on our websites from property owners decide and reservation service offering either online or through the booking form.

In this case the owner must provide photos, text descriptions and features requested by the system.
All this will need to sign a contract with COMERCIO EUROPEO CESA, S.A. In this case the percentage of commission will be to agree the services contracted depending on the total accepted bookings for this accommodation and the conditions and responsibilities are described in the contract.

 

II.-Standard Management:

In which case CESA will offer the owner:
A) Promotion and publication of your property with texts written by the owner, up to 20 images and features, owner control panel to verify its properties published and reservations.
B) Personal advice to choose or change the photos for publication on the web and descriptive text to be included.

CESA is not responsible for their reservations or intervene in any way related to her apartment, only bring our system to house their own information which must meet the requirements stated on this website.

In this case, the commission will be 15% on reservations for this accommodation and accepted through the web. This percentage will be charged in respect of "reserve amount" at the time of payment

CESA sole responsibility of this website and is only and exclusively to provide concrete and selected stocks in this case described.
